Despido ineficaz y tutela judicial efectiva en caso de personas con discapacidad

Abstract

Unfair dismissal and effective judicial protection as mechanisms for safeguarding the enhanced job security of people with disabilities in Ecuador. This study examines the current constitutional, legal, and jurisprudential framework. It concludes that, although there is formal recognition of job security and full redress, in practice, monetary compensation predominates. This situation weakens reinstatement as the primary guarantee. Thus, a gap is evident between the law and the actual protection of the right to work.
