| Abstract: | This study analyzes the exclusion, rejection and inadmissibility of the means of evidence announced in the evaluation and preparatory hearing of the trial in Guayaquil, with the aim of identifying the normative, doctrinal and jurisprudential criteria that support the judicial decision, evaluate its practical application and propose guidelines that strengthen uniformity, predictability and respect for fundamental rights in the criminal process. |
| Translated abstract: | El presente estudio analiza la exclusión, rechazo e inadmisibilidad de los medios de prueba anunciados en la audiencia evaluatoria y preparatoria de juicio en Guayaquil, con el objetivo de identificar los criterios normativos, doctrinales y jurisprudenciales que sustentan la decisión judicial, evaluar su aplicación práctica y proponer lineamientos que fortalezcan la uniformidad, predictibilidad y respeto a los derechos fundamentales en el proceso penal. |
