| Abstract: | This study examines the exceptional nature of pre-trial detention (prisión preventiva) within the judicial practice of Guayaquil during the 2023–2025 period, focusing on the persistent tension between Ecuador’s legal framework which defines this precautionary measure as ultima ratio, subsidiary, and proportionate and its recurrent use in contexts marked by heightened criminality and institutional pressure. |
