La inteligencia artificial y sus desafíos en la convivencia democrática entre poderes del estado

Abstract

This research examines the incorporation of artificial intelligence into the democratic coexistence among the branches of government in Ecuador and the challenges its implementation poses to the system of checks and balances. The study adopts a qualitative approach based on bibliographic review, normative and doctrinal analysis, and the examination of specialized sources. The findings reveal significant regulatory gaps regarding algorithm governance, data protection, and mechanisms of human oversight in the public sector. At the same time, potential benefits are identified in terms of administrative and judicial process optimization, information management, and institutional efficiency. However, relevant risks are also highlighted, particularly those related to algorithmic bias, technological dependence, and possible impacts on fundamental rights. The study concludes that artificial intelligence may contribute to strengthening institutional performance and democratic coexistence among state powers only if it is implemented within clear regulatory frameworks, ethical principles, and effective human supervision.
