Derechos morales y patrimoniales en obras realizadas con inteligencia artificial

Abstract

This article addresses the moral and property rights related to works generated by artificial intelligence (AI). As technology advances, a number of questions can be observed to arise regarding copyright ownership and the protection of creations. This article uses the qualitative method to analyze the current legal context and the implications of Artificial Intelligence in artistic production. Aspects such as the perspectives of authors and legislators on the subject are examined and discussed. The results indicate that, although current legislation offers some protection, a clearer legal framework is needed to address the obstacles presented by Artificial Intelligence in the production of works. It is concluded that the recognition of moral and property rights is essential to foster creativity and protect authors in an ever-evolving digital environment.
