Abstract

This research examines state responsibility in the management of captive wildlife in Ecuador, with an emphasis on the case of Estrellita the monkey (Judgment No. 253-20- JH/22). Based on a biocentric approach and the constitutionalizing of the rights of nature, a dissonance is identified between the formal compliance with administrative regulations and the effective protection of animal rights. Estrellita the monkey, after living 18 years in a human home, died in state custody, highlighting the need for specialized protocols and individualized approaches. This research is of a legal and doctrinal nature, supported by bibliographic review and jurisprudential analysis.
