Secreto Industrial en Empresas Públicas a través de un análisis bajo el Principio de Transparencia

Abstract

Public companies are subject to the principle of transparency, however, being economic agents, they develop activities of production of goods and services, therefore, they are subject to the instruments of protection of intellectual property, including industrial secrecy. In Ecuador, the absence of regulations that articulate this relationship, questions the compatibility between transparency and confidentiality of strategic information of public companies. The present research work aims to analyze the possible interrelation between the disclosure of information and the protection of strategic economic interests. The methodology used was a qualitative approach, with the application of the analytical-synthetic method to collect and analyze the substantial information on these aspects. The results suggest that the interrelation between industrial secrecy and the principle of transparency is possible as long as the scope of the protected information and the aspects to be kept from public access are delimited.
