Abstract

The death penalti and human rights have led society and the judicial system to adopt two opposing stances, sparking debate over the procedures to follow regarding whether or not this sanction should be reinstated, base don national and international regulations. The objective of thid research is to contribute to illustrating the debate between the death penalti and the right to life from a qualitative perspective and a synthetic-analytical method, in order to determine the feasibility of reinstating this capital punishment in Ecuadorian legislation, as well as the action required by the State to ensure its implementation
