The institutional representations oscillate between an “infantilization” of the child, subordinating his character as a person to his infantile conditions, under the risk of making him childish in his development, and an “adulteration” of the child, that subordinates his infantile condition to the character as a person. Today the neoliberal speech, the market and an irresponsible infantology try to free the child from his infantile conditions, to make him behave like an adult. The attribution of a complete set of rights to the child whose possibilities to carry them out abstain from his real infantile conditions, also they tend to make the child similar to an adult before the law, with serious judicial and penal consequences for children precociously criminalized. This is the way how the present-day society eludes all the responsibility that has to do with infantile delinquency and criminality which is each time more precocious.

Because of the effects of post-modernity and the social and correlative family destructuring, the identity
construction of the individual has been complicated and adolescence has become a stage of life which is
hard to go through and overcome because they don’t have a life ideal and ethical structuring references. For young people of the marginality, this situation is even more complex due to multiple material shortages as well as psychological, educational and cultural deficits which they experience. The strength when they do something, typical of this age, makes them perpetrate very serious criminal transgressions. The only way to revert their criminal destiny would be to create policies of socio-cultural inclusion within a new symbolic institutionality.

The cases of incest, most of the times, are not unveiled; the situation of violence and permanent abuse is used to taking place very often, it makes in one way or another the girl remain caught in her terrible secret and hide it for a long time. On the other hand, in the few cases that go to the justice process, the father is lockedup in a prison where he gets permanent maltreatment from the other prisoners, and the girl, victim of incest is used to feeling an intense guiltiness due to this fact.
The penal mediation, a judicial process carried out under the responsibility of a public prosecutor, allows
–without dictating any sanctions- to reestablish a relationship between the father and the daughter, in order to help the reinsertion of both in a society founded on the Universal Law of Incest Prohibition.

The study makes a brief review of the contemporary evolution in the Developing Countries by using as a reference what Max Weber called the exceptionality of the European evolution, which has represented the great peculiarity around the world: the specialization of roles and functions, the rationalization of daily life and the application of these principles to the fields of knowledge, law, administration and economics, and that have had to do directly with the generation of prosperity in the long term and in favor of wide social layers. On the other hand, the processes of modernization in the Developing Countries try to create an original and own order that helps to establish a solid identity distinguishable from other politic-social regimes. But the global result is a model of mediocrity and imitation. Is this imitation of the western paradigm a mandatory law for evolution?
The interpretation of this asymmetric relation is guided by the prudence and based on the experience which judges according to what is probable, feasible and reasonable and that does not exempt the need of emitting appraising judgments?

In the context of the democratic boom in the 80’s, most of the Latin American countries and nations from
other parts of the world lived multiple impacts; one of the topics that got prominence from that reformist
movement was the modernization of the State through the decentralization of the sectional governments,
considered as one of the main political centralized strategies to make flexible and democratize the centralized and rigid institutional political systems, this, in some countries, favored the design of their own developing plans for the local governments. In others, like in Ecuador, it did not have repercussion; it was more a speech than a consolidated political practice in the geographical regions, provinces and cities.
